to provide voluntary charitable donation ( free transfer of property, monetary means) in general (charitable) purposes.
1.1. This Public Offer to provide voluntary charitable donation (hereinafter- "Offer"), according to the article 641 of The Civil Code of Ukraine is the preposition of the Charitable Organization "Charitable Foundation "Peaceful Heaven of Kharkiv", identification code of a legal entity 44877407, which is located in: Ukraine, Kharkov, Tankopia street, 23, flat 91 (hereinafter -"The Fund"), the head of the Fund is Lyubimskyi Stanislav Georgiyovych, which acts on the basis of the Regulations, indefinite circles able physical persons and legal entities under private law, who voluntary carried out charitable activity (hereinafter each of these persons- "Benefactor "), to enter into an Agreement on the provisions of charitable donation (hereinafter-"Agreement") on the terms described in this Offer, with each Benefactor, who applies.
1.2. This Offer takes enters into force from the moment of its posting on the website of the Foundation, on the internet at the link: https://www.mn.org.ua/ (hereinafter- the "Site"). This Offer is indefinite and may be changed on revoked by the Fund at any time (to its acceptance by the Benefactor) by posting relevant information on the Site.
1.3. The Fund is able to enter into Agreements for providing of charitable donation in a different order and/or under different conditions than provided for in this Offer. The Benefactor can separately apply to the Fund to enter into such an Agreement.
2.1. The subject of the Agreement is free and charitable transfer by the Benefactor the funds for the Fund, by making a charitable donation for the implementation of the Fund's statutory activities. The Benefactor independently determines the size of the charitable donation. The Fund independently determines the directions of using of the charitable donation within the framework of its own statutory activities, unless otherwise determined by the Benefactor in accordance with the procedure established by this Agreement. The subject of this Agreement isn't receipt of profit directly to the Agreement.
2.2. Transfer of funds by the Benefactor under this Agreement is recognized as charitable donation in accordance with Article 6 of the Law of Ukraine "About charitable activities and charitable organizations.
2.3. If desired, the Benefactor can specify the target destination of charitable donation, choosing amount the programs (projects), goals, announced by the Fund.
3.1. The Fund carries out charitable activities, aimed at direct support of Ukrainians, who remained in the zone of active military operations, with products, medicine, evacuation, in particular medical transport, and also conducts other types of charitable activity, in accordance with its Regulations.
3.2. The activity of the Fund is not aimed at making a profit.
3.3. Information about the activity of the Fund and activity results reports are posted on the website.
4.1. The Benefactor determines independently the size of the charitable donation.
4.2. The charitable donation is voluntary and is not subject to further return to the Benefactor.
4.3. In accordance with this Offer and Agreement, charitable donation is provided by the Benefactor and is used by the Fund to conduct and provide charitable activity (implementation of directions, purposes of charitable activities and charitable programs) of Fund in accordance with the Regulations and legislation of Ukraine. The Benefactor agrees with such purpose of his donation.
4.4. Methods of introduction of charitable donation- one-time payment.

5.1. When paying for the order by bank card, payment processing (including entering the card number) takes place on a protected page of the processing. It means that your confidential data ( card details, registration data, etc) do not reach us, their processing is fully protected and nobody can get personal and bank data of the client.
5.2. When working with card data, the information protection standard applies, developed by international payment systems Visa and MasterCard- Payment Card Industry Data Security Standard (PCI DSS), which ensures safe processing of details of the owner's Bank card. The applied technology of data transmission guarantees the safety of operations with Bank cards by using protocols Secure Sockets Layer (SSL).
6.1. The Fund undertakes to use the funds of the Benefactor's charitable donation in strict accordance with the legislation of Ukraine and only within the framework of its statutory activity.
6.2. The fund has the right to independently determine the directions of use charitable donation in accordance with its statutory activity and the legislation of Ukraine, except in cases, when the Benefactor defined a specific goal of his donation under a separate agreement with the Fund. Thus, if a specific goal of Benefactor's charitable donation isn't defined, it is considered that the donation submitted for implementation of statutory activities by the Fund.
6.3. The Benefactor has a right to receive information about using of his charitable donation. For this purpose, the Fund can post monthly financial reports on the website, which include information about amounts of donations received by the Fund during the reporting period and expenses by the Fund during the reporting period. At the benefactor's request the Fund can also confirm the intended use of the charitable donation with additional documents. Access to reports about using of charitable donation is provided by the fund in the manner and within the terms stipulated by the current legislation of Ukraine.
6.4. By making a charitable donation, the Benefactor unconditionally affirms his legal capacity, voluntary conclusion of the deed, that the object of the charitable donation is not subject to a ban, seizure, is not in lien, is not encumbered by any other rights of third parties, and was not acquired in violation of the Law of Ukraine "On preventing and countering the legalization (laundering) of criminal proceeds, the financing of terrorism, and the financing of the proliferation of weapons of mass destruction. If the Fund has reasonable doubts about these statements, the Fund has right to ask and the Benefactor undertakes to provide appropriate supporting evidence for these statements.
7.1. Acceptance - full and unconditional acceptance of a public offer by taking actions related to making a money transfer using the payment forms and means posted on the Site, as well as by transferring funds to the fund's current account through bank institutions. The moment of Acceptance is the date of money transfer and/or crediting of funds to the Fund's bank account.
7.2. Acceptance of the Offer means that the Benefactor agrees with all its provisions and is fully aware of and agrees with the subject of the Agreement, for the purpose of public collection of donations and with the right of the Foundation to use a part of the Benefactor's charitable donation for the administrative expenses of the Foundation, in an amount not greater than that provided for by the legislation of Ukraine.
The Benefactor and the Foundation, guided by Article 207, Part 2, Article 639, Article 641, Article 642 of the Civil Code of Ukraine, agree that from the moment of Acceptance, the Agreement is considered concluded in writing. At the same time, the parties agree that the parties' failure to comply with the written form of the deed does not mean its invalidity.
7.3. The Foundation processes the Benefactor's personal data provided when visiting the Site and/or making a money transfer (hereinafter - personal data) for the purpose of proper implementation of this Agreement and its statutory activities. Detailed information on the procedure for processing personal data by the Foundation is available in the Privacy Policy.
8.1. The relations between the Benefactor and the Foundation are governed by the provisions of the current legislation of Ukraine.
8.2. The foundation's liability for violation of this Agreement or the procedure for using charitable donations shall be on the grounds, in the amount and in the manner determined by the requirements of the current legislation of Ukraine.
8.3. In the event of disputes between the parties to this Agreement, they must be resolved through negotiations. If it is impossible to resolve disputes through negotiations, disputes are considered by courts in the manner established by the current legislation of Ukraine.
